1. Acceptance

By creating a RexLink account, you agree to these Terms of Service, our Privacy Policy, our Data Processing Addendum, and our Acceptable Use Policy, each of which is incorporated by reference.

2. Eligibility

You represent that you are at least 18 years of age and have the legal capacity to enter into a binding contract. RexLink is not directed to children under 13, and we do not knowingly collect personal information from children under 13.

3. Subscription and Auto-Renewal

Your subscription renews automatically until you cancel. You may cancel at any time from your account dashboard. Cancellation takes effect at the end of your current billing period. Monthly plans are not refundable after 3 days; annual plans are prorated or non-refundable as disclosed at purchase.

4. Acceptable Use

You warrant compliance with all applicable telemarketing laws, including but not limited to:

• The Telephone Consumer Protection Act (47 U.S.C. § 227) and its implementing regulations, including the FCC's February 2024 declaratory ruling confirming TCPA applies to AI-generated voices.
• The Telemarketing Sales Rule (16 CFR Part 310).
• All applicable state mini-TCPA laws, recording-consent laws, and state DNC registries.

You represent that you possess prior express written consent (as defined by the TCPA) from each recipient before initiating any call through the Service, and that you maintain records of consent sufficient to defend any regulatory investigation or private action.

5. Customer Data and IP Ownership

You own all data you upload to the Service and all outputs generated from your inputs. RexLink retains a license to process your data solely to deliver the Service. RexLink does not train its or its vendors' models on your customer data.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, REXLINK'S AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO REXLINK IN THE TWELVE MONTHS PRECEDING THE CLAIM. REXLINK SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES.

7. Indemnification

You agree to indemnify and hold RexLink harmless from any claim arising from your violation of telemarketing laws, your content, your violation of the Acceptable Use Policy, or your misuse of AI calling features.

8. Arbitration and Class-Action Waiver

ANY DISPUTE ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL BE RESOLVED BY BINDING INDIVIDUAL ARBITRATION UNDER THE AMERICAN ARBITRATION ASSOCIATION COMMERCIAL RULES. YOU AND REXLINK EACH WAIVE THE RIGHT TO PARTICIPATE IN A CLASS ACTION. This waiver does not apply to claims excluded by 9 U.S.C. § 402 (sexual assault and sexual harassment).

9. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws principles.

10. Changes

RexLink may update these Terms. Material changes require an in-app re-acceptance gate before continued use. Non-material changes are published to the legal changelog.
